Appeals Question

If my boyfriend has won an appeal, what are the next steps he takes after that? who do i consult ? and what should be our next move?

Thanks for your question.

My first recommendation is to absolutely meet with an attorney that is experienced in that practice area. Many think an appeal means the case is dismissed and it is over. That is rarely true. In fact, most appeals simply reverse a specific ruling by the lower court and the appeals court often remands (sends back) the case to the trial court. In many ways this means you are starting all over again.

A lawyer will need to not only review the ruling from the appeals court, but also need to review the entire case to ensure he/she is well informed about the case. For example, in a criminal case this extensive review will allow the attorney to advise your boyfriend whether a dismissal is possible, whether it should be set for a second trial, or whether it may impact a new plea agreement.

Appeals are often decided on very specific and complicated legal issues. It is imperative that you and your boyfriend find a lawyer that is knowledgeable and can help guide him through this process.
