Multiple DUIs Increase Potential Penalties

A DUI charge can have severe penalties for the accused, and prior convictions only increase those potential penalties. In this blog post, a Florida DUI attorney examines how prior DUI convictions could increase potential penalties for a new DUI charge.

Typical Penalties for a Florida DUI

The potential penalties for a first-time Florida DUI are as follows:

  • Fine of not less than $500 or more than $1,000; and/or
  • Imprisonment for not more than six months;
  • Minimum 180 days license revocation, maximum one year; and
  • DUI school.

These penalties are severe, but they only increase with multiple convictions.

Potential Penalties for Subsequent DUI Convictions

The potential penalties for a second-time Florida DUI are as follows:

  • Fine of not less than $1,000 or more than $2,000; and/or
  • Imprisonment for not more than nine months (if the second conviction is within five years of a prior conviction, mandatory imprisonment of at least ten days);
  • If the second conviction is within five years of a prior conviction, minimum five years license revocation; and
  • DUI school.

For a third-time Florida DUI, the potential penalties skyrocket:

  • Fine of not less than $2,000 or more than $5,000; and/or
  • Mandatory imprisonment of at least 30 days, but not more than 12 months;
  • Minimum ten years revocation if the third offense is within ten years of the second conviction.

Penalties increase at every level when the DUI charge includes one of the following:

  • Bodily injury to others;
  • Manslaughter;
  • Property damage;
  • Driver’s blood alcohol level (BAL) higher than .15;
  • Minor in the vehicle.
