What is divorce mediation?

Divorce mediation is an alternative to divorce court. Couples are encouraged to discuss the different aspects of their divorce with the help of a mediator. The mediator is an impartial third party who facilitates open communication and negotiation, without forcing either spouse to agree to any decisions. The mediator does not have the ability to make decisions for the spouses.

Is mediation better than going to court?

For many couples, yes. Mediation is known for being much faster, cheaper, and more effective than going to court. Depending on the issues at hand, a mediated divorce can be resolved in as little as one day. Other couples may meet for several weeks or months. Mediation can also protect children and helps many spouses improve their communication for more positive future interactions.

Will my spouse and I meet together or separately with the mediator?

This may depend on the mediator you work with. While some choose to meet with each spouse separately, others find it more beneficial to include both spouses in every meeting. It is helpful to discuss this with your mediator in advance, to achieve a strategy you both feel comfortable with.

How is court-ordered mediation different than private mediation?

Sometimes, the court chooses to order mediation when there are child custody and visitation issues at stake. Most judges in Florida feel that mediation is especially beneficial for child-related matters and will require spouses to try mediation first before going to court.

What happens if mediation just isn't working for us?

While mediation does have a high success rate, some couples find that they just can't agree on a mutually satisfactory outcome. In this case, you may be required to go to court to resolve the remaining issues of your divorce.
