What is product liability?

To pursue a product liability claim, you will need to understand what laws protect consumers against the dangers and harm associated with defective products. Essentially, when a company, store owner, designer, or inventor creates and sells a product, they assume some amount of liability. Which party is responsible will depend on what level the product became defective or was dismissed despite knowledge of the defect.

For example, a store owner may not have created a product that was defective, yet if they were aware of the dangerous risk and continued to keep that product on the shelf, they may also be held responsible. If they were unaware, it is still their job to make sure the products they are selling meet certain standards.

Some of the following are examples of defective products:

  • Broken or malfunctioning air bags
  • Ineffective seat belts
  • Products that lack proper warning labels
  • Medical equipment that fails to work
  • Medicine that causes dangerous side effects
  • Toys designed for toddlers with small pieces
  • Poorly designed cribs or strollers
  • Defective tire design
  • Machinery malfunctions
  • Hazaderous materials included in product

Depending on the type of defect, you may be able to pursue damages from a wholesaler, a manufacturer, distributor, or any other party involved. We can determine how much your claim is worth and what action you should take next.
